ARTICLE 1. Présentation de la société organisatrice

1.1 La société KINOMAP, ayant son siège social 14 rue de la Mairie – 59500 Douai (ci-après désignée « la Société Organisatrice »), organise un challenge virtuel dédié au sport indoor du 01 décembre 2020 au 24 décembre 2020. (date et heure France métropolitaine faisant foi).

1.2 La Société Organisatrice informe expressément les participants que ce jeu est ouvert à toutes personnes majeures, à l'exclusion des membres du personnel KINOMAP et de toutes personnes ayant participé à l’élaboration du présent règlement.

1.3 La participation au Jeu implique l'acceptation sans réserve du présent règlement (ci-après le« Règlement ») dans son intégralité, ainsi que des lois et règlements applicables aux jeux en vigueur en France.

Le simple fait de participer vaut reconnaissance de lecture et d’acceptation.

ARTICLE 2. Durée

Le Jeu est valable du 01 décembre 2020 au 24 décembre 2020 (date et heure France métropolitaine faisant foi).

La Société Organisatrice se réserve le droit de reporter, de modifier, d'annuler ou de renouveler le Jeu si les circonstances l'exigent. En tout état de cause, sa responsabilité ne saurait être engagée à ce titre.

ARTICLE 3 Principe du Jeu

Décrire comment le participant accède au jeu.

Pour participer au jeu, le participant doit consulter les consignes indiquées sur la page web https://partner.kinomap.com/fr/xmastour. Il devra se créer un compte Kinomap sur le site web www.kinomap.com puis télécharger l’application sur son smartphone ou tablette. Le participant devra ensuite connecter son équipement de cardio-fitness (vélo d’appartement, elliptique, home trainer, tapis de course, tapis de marche ou rameur) à l’application et pédaler sur les vidéos du challenge proposées dans les 5 playlists « XMASTOUR ».

Un tirage au sort aura lieu parmi les participants ayant réalisé au minimum 5 vidéos entre le 1er et le 24 décembre 2020 parmi la sélection de vidéos du challenge XMASTOUR disponibles dans les 5 playlists.

ARTICLE 5 Attribution des lots

Le gagnant sera informé de son gain par l’envoi d’un email sur l’adresse email utilisée pour se créer un compte sur Kinomap.

Le lot ne peut être échangé contre d'autres lots, ni contre des espèces, ni contre tout autre bien ou service.

La Société Organisatrice ne saurait être tenue pour responsable pour tous les incidents/accidents pouvant survenir à l’occasion de l’utilisation du lot.

Avant la remise de son lot, le gagnant devra remplir les conditions définies dans le Règlement justifier de son identité.

Toutes les marques ou noms de produits cités sont des marques déposées de leurs propriétaires respectifs.

ARTICLE 6. Limitation de responsabilité

6.1. La responsabilité de la Société Organisatrice ne saurait être encourue si, pour un cas de force majeure ou indépendant de sa volonté, le Jeu devrait être modifié, écourté ou annulé.

Elle se réserve dans tous les cas la possibilité de prolonger la période de participation, et/ou de reporter toute date annoncée.

Toute modification du présent règlement donnera lieu à la publication de sa nouvelle version selon les mêmes modalités que celles initialement choisies par la Société Organisatrice. La nouvelle version du règlement entrera en vigueur à compter de sa mise en ligne et tout participant sera réputé l’avoir acceptée du simple fait de sa participation au jeu, à compter de la date d’entrée en vigueur de la modification. Tout participant refusant la ou les modifications intervenues devra cesser de participer au Jeu.

6.2. La Société Organisatrice pourra annuler tout ou partie du Jeu s’il apparaît que des fraudes sont

intervenues sous quelque forme que ce soit, notamment de manière informatique dans le cadre de la participation au Jeu ou de la détermination du gagnant. Sera notamment considéré comme fraude le fait pour un participant de s’inscrire puis de participer au Jeu sous un ou des prête-noms fictifs ou empruntés à une ou plusieurs tierces personnes. Toute fraude entraîne l’élimination du participant.

La Société Organisatrice se réserve, dans cette hypothèse, la faculté d’écarter de plein droit toute participation émanant d’un fraudeur, sans que celui-ci ne puisse revendiquer quoi que ce soit.

La Société Organisatrice se réserve le droit de poursuivre en justice quiconque aura fraudé ou tenté de le faire. Elle ne saurait toutefois encourir aucune responsabilité d’aucune sorte vis-à-vis des participants du fait des fraudes éventuellement commises.

6.3. La participation au Jeu implique la connaissance et l'acceptation des caractéristiques et des

limites d'Internet, notamment en ce qui concerne les performances techniques, les temps de réponse pour consulter, interroger ou transférer des informations, les risques d’interruption, et plus généralement, les risques inhérents à toute connexion et transmission sur Internet, l'absence de protection de certaines données contre des détournements éventuels et les risques de contamination par d'éventuels virus circulant sur le réseau.

En conséquence, la Société Organisatrice ne saurait en aucune circonstance être tenue responsable,

sans que cette liste soit limitative :

- du contenu des services consultés sur le Site et, de manière générale, de toutes informations

et/ou données diffusées sur les services consultés sur le Site

- de la transmission et/ou de la réception de toute donnée et/ou information sur Internet

- de tout dysfonctionnement du réseau Internet empêchant le bon déroulement/fonctionnement

du Jeu

- de défaillance de tout matériel de réception ou des lignes de communication

- de perte de tout courrier électronique et, plus généralement, de perte de toute donnée

- des problèmes d'acheminement

- du fonctionnement de tout logiciel

- des conséquences de tout virus, bogue informatique, anomalie, défaillance technique

- de tout dommage causé à l'ordinateur d'un participant

- de toute défaillance technique, matérielle et logicielle de quelque nature, ayant empêché ou limité la possibilité de participer au Jeu ou ayant endommagé le système d'un participant. Il est précisé que la Société Organisatrice ne peut être tenue responsable de tout dommage direct ou indirect issu d’une interruption, d’un dysfonctionnement quel qu’il soit et ce pour quelque raison que ce soit, ou encore de tout dommage direct ou indirect qui résulterait, d’une façon quelconque, d'une connexion au Site. Il appartient à tout participant de prendre toutes les mesures appropriées de façon à protéger ses propres données et/ou logiciels stockés sur son équipement informatique contre toute atteinte. La connexion de toute personne au Site et la participation au Jeu se fait sous leur entière responsabilité. De plus, la Société Organisatrice ne pourrait voir sa responsabilité engagée au titre d’un retard dans l’expédition des lots ou de la non réception de ceux-ci ou d’informations concernant le jeu, lorsque ce retard ou cette non réception ne lui est pas imputable, mais est:

● le fait de prestataire(s) de services auquel elle recourt pour effectuer cette mise à disposition et/ou;

● le fait d’une erreur de la part du gagnant dans les informations qu’il a renseignées, notamment concernant ses coordonnées postales ou emails. Ainsi, la Société Organisatrice ne saurait être responsable de la non délivrance de l’email informant le Participant qu’il a gagné, et ne saurait être tenu de délivrer un lot de remplacement.

6.4 En participant au Jeu, le Participant reconnaît être responsable des informations et des éléments renseignés lors de sa participation et en assure l’exactitude et la validité sous peine de voir sa participation au jeu considérée comme nulle. De plus, chaque participant s’engage à ne pas poster de contenu de nature à porter atteinte aux bonnes mœurs, au respect de la dignité humaine,, à la protection des mineurs et de leur image et au respect de toute réglementation applicable à l'ordre public. A ce titre, les contributions suivantes seront systématiquement refusés : contenu à caractère vulgaire, diffamatoire, injurieux, obscène, raciale ou xénophobe, pornographiques, illégal ou susceptible de l’être, incitant à la consommation d’alcool, de tabac ou plus largement tout élément qui serait considéré comme étant contraire à la morale et/ou au droit. De manière générale, la Société Organisatrice se réserve le droit d’invalider la participation au présent jeu ou le gain, sans avertissement préalable, de tout participant diffusant une contribution ne respectant pas les dispositions du présent règlement ou en cas de de comportement incompatible avec le présent règlement (ex : triche).

ARTICLE 7. Convention de preuve

Il est convenu que, excepté dans le cas d'erreur manifeste, la Société Organisatrice pourra se prévaloir, notamment aux fins de preuve de tout acte, fait ou omission, des programmes, données, fichiers, enregistrements, opérations et autres éléments (tels que des rapports de suivi ou autres états) de nature ou sous formats ou supports informatiques ou électroniques, établis, reçus ou conservés directement ou indirectement par la Société Organisatrice, notamment dans ses systèmes d’information.

Les participants s’engagent à ne pas contester la recevabilité, la validité ou la force probante des éléments de nature ou sous formats ou supports informatiques ou électroniques précités, sur le fondement de quelque disposition légale que ce soit et qui spécifierait que certains documents doivent être écrits ou signés par les parties pour constituer une preuve.

Ainsi, les éléments considérés constituent des preuves et, s’ils sont produits comme moyens de preuve par la Société Organisatrice dans toute procédure contentieuse ou autre, ils seront recevables, valables et opposables entre les parties de la même manière, dans les mêmes conditions et avec la même force probante que tout document qui serait établi, reçu ou conservé par écrit.

En cas d’affichage d’un écran du Jeu indiquant le gain d’un lot, un code crypté unique et personnel sera affiché sur l’écran. Il permettra à la Société Organisatrice de contrôler le lien entre l’écran et le Participant.

ARTICLE 8. Données personnelles - Participation au Jeu

Vous participez à un Jeu organisé par KINOMAP.

En termes juridiques cela s'appelle un contrat.

Pour participer à ce Jeu il vous sera nécessaire de communiquer certaines données personnelles que nous avons besoin de traiter pour vous avertir en cas de gain. Votre participation à notre Jeu n’entraîne aucune prise de décision, relative aux données à caractère personnel, entièrement automatisée de notre part. Vos données personnelles restent à l’intérieur de l’UE, où nous mettons tout en œuvre pour les protéger en respectant la réglementation européenne.

Le destinataire de vos données est la société KINOMAP

Le responsable de traitement de vos données est la société KINOMAP

. Vous pouvez consulter et rectifier ou supprimer vos données personnelles. Sous certaines conditions, vous pouvez aussi demander à ce que vos données soient transférées à une autre entité que KINOMAP. Il vous suffit d'envoyer un email à à cette adresse : support@kinomap.com.

- Vos données seront supprimées dans un délai dix (10) jours après la fin du jeu.

ARTICLE 9. Loi applicable et interprétation

Le présent jeu est exclusivement régi par la loi française notamment pour tout litige qui viendrait à naître du fait du Jeu objet du présent ou qui serait directement ou indirectement lié à celui-ci. Toute question d'application ou d'interprétation du Règlement, ou toute question imprévue qui viendrait à se poser, sera tranchée dans le respect de la législation française.

ARTICLE 10. Consultation du règlement

Le règlement est disponible sur l’interface/la page permettant de participer au présent Jeu. Le Règlement complet sera également adressé par courrier simple, à titre gratuit, à toute personne, sur simple demande adressée à : sales@kinomap.net.

Le timbre sera remboursé sur la base du tarif lent « lettre » en vigueur, sur simple demande accompagnant la demande du Règlement.

Toute demande illisible, incomplète ou envoyée hors délai ne sera pas traitée. Il ne sera répondu à aucune demande orale concernant le Jeu.

1.1 The company KINOMAP, having its registered office at 14 rue de la Mairie - 59500 Douai (hereinafter referred to as "the Organizing Company"), organizes a virtual challenge dedicated to indoor sports from December 01, 2020, to December 24, 2020. (date and time metropolitan France being taken as proof).

1.2 The Organizing Body expressly informs the participants that this game is open to all adults, excluding members of KINOMAP staff and all persons who participated in the development of these rules.

1.3 Participation in the Game implies unreserved acceptance of these rules (hereinafter the "Rules") in their entirety, as well as the laws and regulations applicable to the Games in force in France.

The mere fact of participating is tantamount to the acknowledgment of reading and acceptance.

ARTICLE 2. Duration

The Game is valid from December 01, 2020, to December 24, 2020 (date and time in metropolitan France). 

The Organizing Body reserves the right to postpone, modify, cancel, or renew the Game if circumstances so require. In any event, it shall not be liable in this respect.

ARTICLE 3. Game Principle

Describe how the participant accesses the game.

To participate in the game, the participant must consult the instructions on the web page https://partner.kinomap.com/xmastour. He will have to create a Kinomap account on the website www.kinomap.com then download the application on his smartphone or tablet. The participant will then have to connect his cardio-fitness equipment (exercise bike, elliptical, home trainer, treadmill, or rowing machine) to the application and pedal on the videos of the challenge proposed in the 5 "XMASTOUR" playlists.

A draw will take place among the participants who have made at least 5 videos between December 1st and December 24th, 2020 among the selection of videos of the XMASTOUR challenge available in the 5 playlists.

ARTICLE 5 Attribution of prizes

The winner will be informed of his gain by sending an email to the email address used to create an account on Kinomap.

The prize cannot be exchanged against other prizes, neither against cash nor against any other good or service.

The Organizing Body cannot be held responsible for all incidents/accidents that may occur during the use of the prize.

Before the prize is awarded, the winner must meet the conditions defined in the Rules and Regulations and prove his or her identity.

All brands or product names mentioned are registered trademarks of their respective owners.

ARTICLE 6. Limitation of liability

6.1. The liability of the Organizing Body shall not be incurred if, due to a case of force majeure or beyond its control, the Game should be modified, shortened, or cancelled.

It reserves the right in all cases to extend the participation period and/or postpone any announced date.

Any modification of these rules will result in the publication of a new version of the rules in accordance with the same terms and conditions as those initially chosen by the Organizing Body. The new version of the rules will come into force as soon as it is posted online and any participant will be deemed to have accepted it by the mere fact of his/her participation in the game, as of the effective date of the modification. Any participant who refuses to accept the change(s) will have to stop participating in the Game.

6.2. The Organizing Body may cancel all or part of the Contest if it appears that fraud has been committed.

intervened in any form whatsoever, in particular in a computerized manner in the context of participation in the Game or the determination of the winner. In particular, the fact that a participant registers and then participates in the Game under one or more fictitious or borrowed names from one or more third parties will be considered fraud. Any fraud will result in the elimination of the participant.

The Organizing Body reserves the right, in this case, to automatically exclude any participation by a fraudster, without the latter being able to claim anything.

The Organizing Body reserves the right to take legal action against anyone who has defrauded or attempted to do so. However, it shall not incur any liability of any kind vis-à-vis the participants because of any fraud that may have been committed.

6.3. Participation in the Game implies knowledge and acceptance of the features and characteristics of the Game.

limitations of the Internet, in particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption and, more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible misappropriation and the risks of contamination by possible viruses circulating on the network.

Consequently, the Organizing Body shall under no circumstances be held liable,

without this list being restrictive:

- the content of the services consulted on the Site and, in general, all information

and/or data disseminated on the services consulted on the Site

- the transmission and/or reception of any data and/or information on the Internet

- any malfunction of the Internet network preventing the smooth running of the network. of the Game

- failure of any receiving equipment or communication lines

- the loss of any e-mail and, more generally, the loss of any data

- routing problems

- the operation of any software

- the consequences of any virus, computer bug, anomaly, technical failure

- any damage caused to a participant's computer

- any technical, hardware, and software failure of any kind that prevented or limited the possibility of participating in the Game or damaged a participant's system. It is specified that the Organizing Body shall not be held liable for any direct or indirect damage resulting from any interruption or malfunction of any kind for any reason whatsoever, or for any direct or indirect damage resulting in any way whatsoever from a connection to the Site. It is the responsibility of each participant to take all appropriate measures to protect his or her own data and/or software stored on his or her computer equipment against any attack. The connection of any person to the Site and participation in the Game is done under their full responsibility. Furthermore, the Organizing Body shall not be held liable for any delay in the dispatch of the prizes or the non-receipt thereof or information concerning the Game, when such delay or non-receipt is not attributable to the Organizing Body, but is:

● the fact of the service provider(s) that it uses to make this provision and/or;

● the fact of an error on the part of the winner in the information he or she has provided, in particular concerning his or her postal or email address. Thus, the Organizing Body shall not be liable for the non-delivery of the email informing the Participant that he/she has won, and shall not be required to deliver a replacement prize.

6.4 By participating in the Game, the Participant acknowledges that he/she is responsible for the information and elements provided during his/her participation and ensures the accuracy and validity thereof, failing which his/her participation in the Game shall be considered null and void. Furthermore, each Participant undertakes not to post any content that may be detrimental to morality, respect for human dignity, the protection of minors and their image, and compliance with any applicable public order regulations. As such, the following contributions will be systematically refused: the content of a vulgar, defamatory, offensive, obscene, racial or xenophobic, pornographic, illegal or likely to be, inciting the consumption of alcohol, tobacco, or more broadly any element that would be considered contrary to morality and/or the law. In general, the Organizing Body reserves the right to invalidate the participation in the present game or the prize, without prior warning, of any participant who publishes a contribution that does not comply with the provisions of the present rules or in the event of behavior incompatible with the present rules (e.g. cheating).

ARTICLE 7. Evidence agreement

It is agreed that, except in the case of manifest error, the Organizing Body may avail itself, in particular for the purposes of proof of any act, fact or omission, of the programs, data, files, records, operations and other elements (such as monitoring reports or other reports) of nature or in a computer or electronic formats or media, established, received or kept directly or indirectly by the Organizing Body, in particular in its information systems.

The participants undertake not to contest the admissibility, validity or probative force of the elements of nature or in a computer or electronic formats or media mentioned above, on the basis of any legal provision whatsoever and which would specify that certain documents must be written or signed by the parties to constitute proof.

Thus, the elements considered constitute proof and, if they are produced as evidence by the Organizing Body in any contentious or other proceedings, they will be admissible, valid, and opposable between the parties in the same manner, under the same conditions and with the same probative force as any document that would be drawn up, received or kept in writing.

In the event that a Game screen is displayed indicating the winning of a prize, a unique and personal encrypted code will be displayed on the screen. It will enable the Organizing Body to control the link between the screen and the Participant.

ARTICLE 8. Personal Data - Participation in the Game

You participate in a Game organized by KINOMAP.

In legal terms, it is called a contract.

In order to participate in this Game, it will be necessary for you to communicate certain personal data which we need to process in order to notify you in the event of a win. Your participation in our Game does not entail any decision making, relating to personal data, fully automated on our part. Your personal data remains within the EU, where we make every effort to protect it in accordance with EU regulations.

The recipient of your data is the company KINOMAP.

The person in charge of processing your data is the company KINOMAP

. You can consult and rectify or delete your personal data. Under certain conditions, you can also request that your data be transferred to an entity other than KINOMAP. Simply send an email to this address: support@kinomap.com.

- Your data will be deleted within ten (10) days after the end of the game.

ARTICLE 9. Applicable law and interpretation

The present game is exclusively governed by French law, in particular for any dispute that may arise as a result of the Game that is the subject of the present document or that is directly or indirectly related to it. Any question of application or interpretation of the Rules, or any unforeseen question that may arise, will be decided in accordance with French law.

ARTICLE 10. Consultation of the regulations

The rules are available on the interface/page allowing you to participate in this Game. The complete Rules will also be sent by post, free of charge, to any person upon request to sales@kinomap.net.

The stamp will be reimbursed on the basis of the current "letter" slow rate, upon simple request accompanying the request for the Rules.

Any application that is illegible, incomplete, or sent after the deadline will not be processed. No oral requests concerning the Game will be answered.
